Hereafter referred to as “VB-Arts”, “the Artist” or “the Seller”.By placing an order through the website, the customer confirms that they have read and accepted these Terms and Conditions of Sale before completing their purchase.

1. Scope

These Terms and Conditions govern the sale of products offered by VB-Arts through the website www.vb-arts.com.Products may include:

• original artworks;

• limited edition art prints;

• open edition art prints;art cards;

• Art Tote bags;

• Artist Greeting Cards

• other art-derived products offered under VB-Arts.

The products available for sale and their essential characteristics are described on their respective product pages.Photographs and images are intended to represent the artworks and products as accurately as possible. Minor variations in colour may occur depending on screen settings and lighting conditions.

2. Original Artworks

Each original artwork sold by VB-Arts is unique unless otherwise expressly stated. The product page specifies, where applicable:

• title;

• dimensions;

• medium;

• support;

• year of creation;

• framing information;

• availability;

• certificate of authenticity.

The sale of an original artwork transfers ownership of the physical artwork only :

All copyright, reproduction, adaptation, publication and intellectual property rights remain the property of Virginie Bergar unless expressly transferred by a separate written agreement.

3. Prints and Art-Derived Products

Limited edition prints are produced in the quantity stated on the relevant product page. Where applicable, limited editions are numbered and/or accompanied by a Certificate of Authenticity. Open edition prints are not individually numbered unless otherwise stated. Art-derived products may present slight variations in colour, placement or appearance depending on the manufacturing and printing process.

4. Prices

Prices are displayed in euros (€), unless otherwise stated. VB-Arts benefits from the French VAT exemption scheme. VAT is therefore not charged to the customer. Prices displayed on product pages do not include shipping charges unless expressly stated otherwise. Shipping charges are shown before the customer confirms the order. For certain large artworks or certain international destinations, shipping may require an individual quotation. In such cases, the customer may be asked to request a personalized shipping quote before completing the purchase. For deliveries outside the European Union, customs duties, import taxes or other local charges may be imposed by the destination country. These costs are not included in the price charged by VB-Arts and remain the responsibility of the customer.

5. Orders

The customer selects the desired product and adds it to their shopping cart. Before completing the purchase, the customer can review the order, correct any errors and view the total price including applicable shipping charges. The order becomes final once payment has been successfully completed and an order confirmation has been issued. VB-Arts reserves the right to refuse or cancel an order in the event of:

• a payment problem;

• suspected fraud;

• an obvious pricing or technical error;

• product unavailability;

• an unresolved dispute relating to a previous order.

If an order is cancelled after payment, the amounts paid will be refunded.

6. Product Availability

Original artworks are unique and are therefore available in a single unit unless expressly stated otherwise. The website inventory is updated as regularly as possible. In the unlikely event that an artwork or product is no longer available after an order has been placed, the customer will be informed as soon as possible and fully refunded.

7. Payment

Payment is due in full when the order is placed. Available payment methods are those displayed at checkout. Payments are processed through the secure payment providers integrated into Squarespace. VB-Arts does not directly store the customer's full payment card information.

8. Order Confirmation

After completing the order, the customer receives an order confirmation at the email address provided during checkout. The customer is responsible for ensuring that the email address supplied is correct. The order confirmation summaries the essential information relating to the purchase.

9. Shipping

VB-Arts ships to the destinations available at checkout. Shipping methods and costs vary depending on:

• destination;

• artwork or product size;package dimensions;

• weight;

• delivery service.

The applicable shipping cost is displayed before the order is confirmed. Certain large artworks or destinations may require a personalized shipping quote.

10. Preparation and Delivery

Orders are prepared with care before shipment. Orders are generally prepared within 3–5 business days after payment confirmation, unless otherwise stated on the relevant product page. This preparation period does not include carrier transit time.

The customer must provide a complete and accurate delivery address. VB-Arts cannot be held responsible for delays or additional costs resulting from incorrect or incomplete information supplied by the customer. Once an order has been shipped, tracking information will be provided when available.

11. Receipt and Transport Damage

The customer is encouraged to inspect the package upon delivery. If the package appears visibly damaged, crushed, opened or otherwise compromised, the customer should, where possible:

• record the condition of the package;

• take photographs before opening it;

• report visible damage to the carrier;

• contact VB-Arts as soon as possible.

If the artwork or product has been damaged during transport, the customer should retain all packaging materials and provide photographs of:

• the external package;

• the internal packaging;

• the damaged artwork or product.

These elements may be required to submit a claim to the carrier.The customer's statutory rights remain unaffected.

12. Right of Withdrawal

For distance sales to consumers, the customer generally has a period of 14 days to exercise their right of withdrawal without giving a reason. For the purchase of goods, this period generally begins on the day the customer, or a third party designated by them other than the carrier, receives the goods. To exercise this right, the customer must clearly inform VB-Arts of their decision to withdraw within the applicable period. A model withdrawal form is made available on the website. The customer may also exercise the right of withdrawal through the online withdrawal functionality provided on the website where applicable.

13. Exceptions to the Right of Withdrawal

The right of withdrawal does not apply where an exception provided by applicable consumer law applies. In particular, products made to the customer's specifications or clearly personalized may be excluded from the right of withdrawal. This may apply, for example, to a commissioned or individually personalized artwork created specifically at the customer's request. The absence of a right of withdrawal will be clearly indicated before the order is placed where applicable.

14. Returns Following Withdrawal

Where the right of withdrawal applies, the customer must return the product within the statutory period after communicating their decision to withdraw. Unless otherwise required by law or expressly stated by VB-Arts, return shipping costs are borne by the customer. Products must be returned with reasonable care and, where possible, using packaging offering equivalent protection to the original packaging .The customer may be liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and proper functioning of the goods.

15. Refunds

Where a valid right of withdrawal has been exercised, VB-Arts will refund the amounts due in accordance with applicable consumer law. Refunds are normally made using the same payment method used for the original transaction unless another method has expressly been agreed. VB-Arts may defer reimbursement until the goods have been received back or until the customer provides evidence that they have sent the goods back, where permitted by law.

16. Legal Guarantee of Conformity

Consumers benefit from the statutory legal guarantee of conformity applicable under French consumer law. This legal guarantee applies independently of any commercial guarantee that may otherwise be offered. Where the legal guarantee applies, the consumer may exercise the remedies provided by applicable law in the event of a lack of conformity.

17. Hidden Defects

The customer also benefits from the statutory guarantee against hidden defects provided under French law. Where the legal requirements are met, the customer may exercise the remedies available under the applicable provisions of the French Civil Code.

18. Intellectual Property

All works created by Virginie Bergar remain protected by copyright and intellectual property law.Purchasing an artwork or product does not grant the purchaser the right to:

• reproduce the artwork;

• commercially exploit it;

• create derivative works;

• use it for advertising or promotional purposes;

• license or transfer reproduction rights.

Any such use requires prior written permission from Virginie Bergar.

19. Personal Data

Personal data collected in connection with orders and customer enquiries is processed in accordance with the VB-Arts Privacy Policy and applicable data protection legislation. The Privacy Policy is available separately on the website.

20. Force Majeure

VB-Arts will not be liable for failure or delay in performing its obligations where such failure or delay results from an event beyond its reasonable control and recognized as a case of force majeure under applicable French law.

22. Consumer Mediation

In accordance with French consumer law, customers have the right to use a consumer mediator free of charge in an attempt to resolve a dispute amicably after first contacting VB-Arts. 23. Applicable Law

These Terms and Conditions of Sale are governed by French law. Where the customer is a consumer residing in another country, this choice of law does not deprive them of any mandatory consumer protection rights that apply in their country of residence.

24. Amendments

VB-Arts may amend these Terms and Conditions of Sale where necessary, including to reflect legal, technical or commercial changes. The version applicable to an order is the version made available to the customer at the time the order is placed.
